Terms and Conditions

Please read these Terms and Conditions in their entirety. They govern the use of all materials, online services, webinars and products of M-PWR CONSULTING SOLUTIONS LLC d/b/a AESTHETIC PRACTICE MANAGEMENT GROUP (“APMG”) used in connection with the #APMG Assembly online learning event. These Terms and Conditions govern your use of APMG’s website and materials regardless of how you access them. 

1. Acceptance of Terms

APMG makes access to the #APMG Assembly subject to these Terms and Conditions. APMG reserves the right to update or make changes to these Terms and Conditions from time to time and may provide you with notice of such changes by any reasonable means, including without limitation, by posting the revised version of these Terms and Conditions. You can determine when these Terms and Conditions were last updated by referring to the date at the end of this page. Your registering for and participating in the APMG Assembly will constitute your acceptance of these Terms and Conditions as amended. By accessing the APMG Assembly, you agree to be bound by these Terms and Conditions. 

2. Registration and Payment

All participants must register and pay the applicable fees prior to the event. Registrations are transferable to another actively employed aesthetic practice manager 30 days prior to a scheduled learning event by submitting such request via email to info@aestheticpmgroup.com. All registration fees are non refundable.

3. Zoom and Technical Requirements

The #APMG Assembly will be conducted using the Zoom platform. Participants are responsible for ensuring they have a stable internet connection and a device capable of running Zoom. APMG is not liable for any technical issues or interruptions in service experienced by participants. When you use the APMG Assembly’s website or materials, you consent to receive communications from us electronically, including but not limited to email, phone call, and text messaging.. You agree that APMG may provide all agreements, notices, disclosures and other communications electronically and satisfies any legal requirement that such communications be in writing.

4. Intellectual Property/Presentation Materials

All content presented during the #APMG Assembly, including but not limited to presentations, videos, audio, and written materials, is the intellectual property of APMG or its speakers. Participants may not reproduce, distribute, or share any content without prior written permission from APMG. APMG or its presenters retain all rights in the materials and content included in the APMG Assembly, including, without limitation, all copyright and other proprietary rights worldwide in all media. You may not use the materials or any of its content or materials except as expressly permitted under these Terms and Conditions. 

The creator or owner of any presentation materials posted during the APMG Assembly retains his/her/their ownership rights in their presentation materials, subject to these Terms and Conditions. For presentation materials provided for use on or in connection with the APMG Assembly, you hereby grant to us a world-wide, royalty-free, fully paid, non-exclusive, perpetual, irrevocable license, without additional consideration to you or any third party, to reproduce, distribute, perform and display (publicly or otherwise), and otherwise use such presentation materials, in any format or media available now or later developed, and for any purpose (including promotional purposes, such as displaying a customer or presenter's comment on APMG’s website as a testimonial). Further, you represent and warrant that you have all necessary rights to grant such license. We may use presentation materials without compensation to you or any other person. You are and remain responsible and liable for the content of your presentation materials.

Without limiting the rights granted above, if you are speaking or otherwise presenting at the APMG Assembly, you consent to APMG’s recording of your presentation (including any slides you use) and to the publication, distribution, exhibition and display of presentation materials. Regarding any presentation materials you submit for use during APMG Assembly, you also consent to APMG’s reproduction, publication, distribution, exhibition and display of such presentation materials. APMG may exercise these rights in all forms and media, whether now known or later developed, throughout the world. Your consent is irrevocable and extends to APMG and its successors, assignees, and licensees, and includes the right to use your name, photograph, likeness, voice, statements and professional biography. APMG will not edit or change the presentation, materials, photos, biography, or other materials associated with presenters, except as necessary to comply with the law or to avoid violating others' rights.

You confirm that you have the authority to grant the above-described nonexclusive license relating to presentation materials and your presentation and that neither will violate the rights of anyone else. You also confirm that, to the extent your presentation or presentation materials includes third-party material, you have obtained permission for the use of third-party content consistent with the scope of this license. Upon APMG’s request, you agree to provide APMG with satisfactory evidence of your permission to use all third-party material with proof of reprint permission.

5. Recording and Privacy

APMG reserves the right to record the Assembly sessions for internal use, quality assurance, and future reference. By participating in the event, you consent to the recording of your likeness, voice, and chat contributions. APMG will not share or distribute these recordings to third parties without your explicit consent.

APMG grants you with a limited license to access and make personal use of this site, subject to these Terms and Conditions. You may view, copy or print materials from the APMG Assembly subject to the following conditions: 

  • You will use the materials for internal, personal, non-commercial, informational purposes only.

  • You will not copy, distribute, modify, transmit, reuse, repost, or otherwise display material from the APMG Assembly for commercial or public purpose without the prior written permission of APMG for each such use.

  • You will comply with all applicable laws, rules, and regulations while accessing or using the APMG Assembly. Also, users are directed to respect the rights and dignity of others. 

6. Code of Conduct

Participants are expected to behave professionally and respectfully during the APMG Assembly. Harassment, discrimination, or disruptive behavior will not be tolerated. APMG reserves the right to remove any participant engaging in such behavior from the event without refund.

7. Limitation of Liability

APMG and its representatives shall not be liable for any direct, indirect, incidental, or consequential loss, injury, claim, liability or damage of any kind resulting or arising from the APMG Assembly, including but not limited to technical difficulties, content accuracy, speaker cancellations, content, or any materials.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Pennsylvania. Any disputes arising from the #APMG Assembly shall be subject to the exclusive jurisdiction of the courts in Pennsylvania. You now consent and submit to the personal jurisdiction of such courts to bring any such claim or action. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages such as included in this Terms of Use. If you are a resident of New Jersey or of any state or jurisdiction that excludes such warranties and liabilities by law, some of the above limitations may not apply to you. Consult with your legal counsel for further information.

9. Legal Disclaimer

The information provided on this website, by any member or guest speaker,  or from any virtual event is for general informational purposes only and does not constitute legal advice. APMG makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information contained on this website or any virtual event. Any reliance you place on such information is strictly at your own risk. APMG will not be liable for any loss or damage arising from the use of this website, any virtual event, or its content.

10. Severability of Provisions

These Terms and Conditions constitute the entire agreement concerning access to and use of the APMG Assembly. If any provision of these Terms and Conditions is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
